Welcome to Sirius Canine Fertility Inc. ("Sirius," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at https://siriuscaninefertility.com (the "Site"), including account creation, the Stud Dog Directory, paid listing services, client portals, and any other features or services we offer through the Site (collectively, the "Services"). These Terms apply to all users worldwide.
By accessing the Site, creating an account, or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site or create an account.
You must be at least 18 years of age to create an account or use our Services. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
To access certain features of the Site, including the client portal, dog profile management, and the Stud Dog Directory, you must create an account. When creating your account, you agree to provide accurate, current, and complete information and to update that information as necessary to keep it accurate.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorized access to or use of your account.
Each user may maintain only one account. Accounts are created through our onboarding process and are linked to a unique user profile. You may not create multiple accounts, share your account credentials with others, or transfer your account to another person without our prior written consent.
Sirius Canine Fertility is a canine reproductive services company based in the United States, serving clients worldwide. Through the Site, we offer:
Client Portal: Registered clients can view their dog profiles, collection reports, shipment logs, and related records through a secure dashboard.
Stud Dog Directory: Users may create paid listings to advertise stud dogs in our public directory.
Informational Content: Blog posts, service descriptions, pricing information, educational resources, and company announcements.
In-Clinic Services: Semen collection and freezing, transcervical insemination, progesterone testing, export/import facilitation, and other reproductive services as described on the Site. These in-clinic services are governed by separate agreements and policies provided at the time of service.
By submitting a stud dog listing, you represent and warrant that:
You are the legal owner of the dog listed, or you have explicit written authorization from the owner to create the listing. All information provided in the listing is truthful, accurate, and not misleading, including but not limited to the dog's registered name, breed, registry, registration number, health information, and any photos. All photos uploaded are of the actual dog being listed and are owned by you or used with permission. The dog is a purebred or purpose-bred dog of the breed specified, and its registry and registration information can be independently verified. The listing does not contain any false pedigree information, fabricated health certifications, or misleading claims about the dog's breeding history or offspring.
Listings may not contain:
False, misleading, or deceptive information about any dog, its lineage, health, or breeding history. Fraudulent registry or registration information. Photos of dogs other than the dog being listed. Content that is obscene, offensive, defamatory, or otherwise objectionable. Spam, advertisements for unrelated products or services, or links to competing platforms. Any content that violates applicable local, state, federal, or international laws or regulations. Health claims or guarantees regarding breeding outcomes, puppy health, or fertility results.
We reserve the right to review any listing at any time and to remove, modify, or suspend any listing in our sole discretion for any reason, including but not limited to violation of these Terms, inaccurate information, complaints from other users, or any other reason we deem appropriate. We are not obligated to provide advance notice before removing a listing, although we will make reasonable efforts to notify you.
Listing duration and renewal terms are as specified at the time of purchase. We reserve the right to modify listing terms, pricing, and availability at any time. Active listings will not be affected by pricing changes until their current term expires.
All payments for stud directory listings and other paid services are processed securely through Stripe, Inc. By making a purchase, you agree to Stripe's terms of service and privacy policy. We do not directly store your credit card or payment information.
All prices are listed in U.S. dollars (USD) and are subject to applicable taxes. International users are responsible for any currency conversion fees charged by their financial institution. We reserve the right to change pricing at any time. Price changes will not affect active listings that have already been paid for.
All purchases of stud directory listings and paid services are final and non-refundable. If you experience an issue with your purchase, please contact us at [email protected] and we will work with you to resolve the matter on a case-by-case basis.
We reserve the right to issue refunds, credits, or other accommodations at our sole discretion in exceptional circumstances.
For users in the European Union, this refund policy does not affect your statutory rights under EU consumer protection law. If you are entitled to a statutory right of withdrawal, you may exercise that right within the applicable period as required by the laws of your country of residence.
You retain ownership of the text, images, documents, and other materials you upload to the Site ("User Content"), including dog profiles, listing descriptions, photos, and documents. By uploading User Content to the Site, you grant Sirius a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely in connection with operating and providing the Services, including displaying your stud dog listing in the public directory.
This license terminates when you delete your User Content or your account, except where your content has been shared with other users or third parties who have not deleted it, or where retention is necessary for legal or operational purposes.
You are solely responsible for all User Content you upload, publish, or display through the Site. You represent and warrant that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party, and does not violate any applicable law in any jurisdiction.
The Stud Dog Directory is a platform that allows users to advertise their stud dogs. Sirius does not own, breed, sell, or endorse any dogs listed in the directory. We do not verify the accuracy of listing information, pedigrees, health claims, or breeding histories submitted by users, and we do not guarantee the quality, health, fertility, or genetic soundness of any dog listed.
Any transactions, communications, or arrangements made between users through the Stud Dog Directory are solely between those users. Sirius is not a party to any agreement between a listing owner and a prospective buyer or breeding partner and bears no responsibility for any disputes, losses, or damages arising from such interactions.
Information provided on the Site about our in-clinic canine reproductive services is for general informational purposes. Specific service terms, veterinary protocols, and liability disclosures are provided separately at the time of service. The Site does not constitute veterinary advice, and you should consult with a licensed veterinarian for any decisions regarding your dog's health or reproductive care.
Our services are available to users worldwide. However, you are solely responsible for ensuring that your use of the Site and Services complies with all applicable laws and regulations in your country of residence, including but not limited to animal welfare laws, import/export regulations for canine genetic material, and any applicable breeding regulations. Sirius makes no representation that the Site or Services are appropriate or available for use in all locations.
When using the Site or Services, you agree not to:
Provide false or misleading information in your account, profile, or listings. Impersonate any person or entity, or misrepresent your affiliation with any person or entity. Use the Site to transmit unsolicited communications, spam, or advertisements. Attempt to gain unauthorized access to other users' accounts or any portion of the Site. Interfere with or disrupt the Site's infrastructure, servers, or networks. Use the Site for any purpose that is unlawful or prohibited by these Terms. Scrape, harvest, or otherwise collect information from the Site through automated means without our prior written consent. Use information obtained from the Stud Dog Directory to contact users for purposes unrelated to legitimate breeding inquiries. Post fraudulent reviews, testimonials, or feedback. Engage in any activity that could damage, disable, or impair the functioning of the Site.
You may delete your account at any time through your account dashboard. Upon deletion, all personal information, dog records, collection reports, stud directory listings, and associated data will be permanently removed.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, submission of fraudulent or misleading listing information, non-payment for services, conduct that we determine in our sole discretion is harmful to other users, the Site, or Sirius, or extended periods of account inactivity.
If your account is terminated by us due to a violation of these Terms, you are not entitled to a refund of any fees paid.
The Site, including its design, layout, text, graphics, logos, icons, images, software, and all other content created by Sirius (excluding User Content), is the property of Sirius Canine Fertility Inc. and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any portion of the Site without our prior written consent.
"Sirius Canine Fertility," our logo, and any other trademarks, service marks, or trade names displayed on the Site are the property of Sirius Canine Fertility Inc. You may not use our trademarks without our prior written permission.
To the fullest extent permitted by applicable law, Sirius Canine Fertility Inc., its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with: your use of or inability to use the Site or Services; any transactions or interactions between users of the Stud Dog Directory; the accuracy, completeness, or reliability of any listing content submitted by users; any breeding outcomes, puppy health issues, or fertility results; unauthorized access to or alteration of your data; or any third-party conduct or content on the Site.
Our total liability to you for all claims arising from or related to the Site or Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Sirius Canine Fertility Inc., its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or Services, your User Content (including any listing information you submit), your violation of these Terms, your violation of any applicable law or regulation, any dispute between you and another user of the Site, or any claim that your User Content infringes upon the rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. If you are a consumer in the European Union, this choice of law does not deprive you of the protection afforded by the mandatory consumer protection provisions of the law of your country of residence.
Before initiating any formal legal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for a period of at least thirty (30) days.
If a dispute cannot be resolved informally, you agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, United States, and you consent to the personal jurisdiction of those courts. If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence.
The Site may integrate with or contain links to third-party services, including Stripe for payment processing and external breeder websites linked from user profiles. We are not responsible for the availability, content, privacy practices, or policies of any third-party services. Your interactions with third-party services are governed by their respective terms and policies.
We reserve the right to modify these Terms at any time. The updated Terms will be posted on this page with a revised "Last Updated" date. We encourage you to review this page periodically. For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you through a notice on the Site, your account dashboard, or the email address associated with your account.
Your continued use of the Site after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site and may delete your account.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Sirius Canine Fertility Inc. regarding your use of the Site and Services. These Terms supersede any prior agreements or understandings, whether written or oral, regarding the subject matter herein.
